Spudshed “Members App Save & Win” Competition 2020

Competition Terms and Conditions of Entry

  1. The promoter is Vegie Bandits Pty Ltd (ACN 079 441 044) trading as Spudshed (ABN 31 079 441 044) (Spudshed).
  2. Information on prizes and how to enter form part of these Terms and Conditions of Entry (T&CE).
  3. By entering this competition entrants agree to be bound by these T&CE.
  4. Entry is open to all West Australian residents aged 18 years or over, excluding employees, suppliers and their immediate family members of Spudshed or any related entities (Eligible Persons).
  5. Spudshed “Members App Save & Win” Competition 2020 runs from 00:00am (AWST) on Monday 7 September 2020 to Midnight (AWST) on Sunday 4 October 2020 (Promotion Period).
  6. This competition is to win the grand prize of (AUD $10,000) Ten Thousand dollars (Grand Prize).
  7. The winner of the Grand Prize will be drawn between Midday (AWDT) and 14:00 (AWDT) on Tuesday 6 October 2020 (Grand Prize Draw) and announced no later than Midday (AWDT) on Tuesday 13 October 2020.

How to enter

  1. Entrants must download the Free Spudshed App and Sign Up to become a Member during the Promotion Period (Eligible Entry).
  2. Entrants must complete all the sign-up fields as required at sign up which includes a valid email address for entry into the competition to be valid (Eligibility Requirements).
  3. Entrants who provide incorrect, misleading or fraudulent information are ineligible in the promotion and all entries of an entrant who is deemed by the Promoter to have provided incorrect or misleading information may, at the discretion of the
    Promoter be deemed invalid.
  4. Only one entry per individual or email address will be accepted.
  5. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  6. Entries are deemed to have been received at the time of receipt into Spudshed’s database and not at the time of transmission by the entrant.
  7. Spudshed may contact an entrant at any time after receiving an entry, including without limitation during or after the promotional period, for the propose of determining whether the entrant meets the eligibility requirements.
  8. Spudshed may require an entrant to provide proof of identity, age and residency. Identification considered suitable for verification is at the Spudshed’s discretion.
  9. Spudshed assumes no responsibility for any incorrect, ineligible, invalid, late, lost or misdirected entries or for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestions on the Internet or at any website, or any combination thereof, including but not limited to, any injury or damage to participants or any other persons computer related to or resulting from participation in or downloading any materials in this competition.
  10. Spudshed reserves the right in its sole discretion to disqualify any individual who Spudshed has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair
    and proper conduct of the competition. Spudshed’s legal rights to recover damages or other compensation from such an offender are reserved.
  11. Details from entries will be collected and used for the purposes of conducting this competition (which may include disclosure to third parties for the purpose of processing and conducting the competition) and for promotional purposes. By completing the online entry, entrants’ consent to receive future Spudshed promotional or marketing materials, including weekly specials and to the use of their information as described. and agree that Spudshed may use this information without any further reference or payment to the entrant.
  12. Entrants consent to Spudshed using their name, likeness, image and or voice in the event that they are a Winner, in any media for an unlimited period of time without remuneration for the purpose of promoting Spudshed and this competition (including any outcome).

Prize draws

  1. Spudshed will randomly select a Winner of the Grand Prize, using a computer drawing system, from Eligible Entries made during the Promotion Period.
  2. The Grand Prize Draw will take place between Midday (AWDT) and 14:00 (AWDT) on Tuesday 6 October 2020.
  3. The Grand Prize Winner will be notified and contacted by email or telephone and will be required to visit a nominated Spudshed store and provide proof of identity that matches their Member Details provided at Sign Up.
  4. If the Winner cannot be contacted or does not respond to any contact made by Spudshed within 3 days, they will forfeit the the Grand Prize and a new Winner will be drawn.

Prizes
 

  1. The Grand Prize is (AUD $10,000) Ten Thousand Dollars which will be transferred to the winner’s nominated Australian bank account via electronic funds transfer.
  2. The winner of the Grand Prize will do all things necessary to enable Spudshed to effect the transfer of the Grand Prize to the winner.
  3. Transfer will take place no later than 30 days from the Grand Prize Draw. Every endeavour will be made to transfer the Grand Prize to the winner within this timeframe. However, any delay in settlement, for any reason, shall not give rise to
    any claim by the winner.
  4. The promoter takes no responsibility for incorrect account details supplied by the winner, and no compensation will be provided in the event that erroneous details are provided.
  5. Spudshed accepts no responsibility for any tax implications that may arise from winning of the prizes. Independent financial advice should be sought.
  6. In the event, there is a dispute concerning the conduct of this competition, the decision of Spudshed is final and binding. As such no correspondence will be entered into.
  7. If for any reason this competition is not capable of running as planned, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of
    Spudshed which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, Spudshed reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition.
  8. To the full extent permitted by law, Spudshed, its employees and any related companies exclude all liability for loss including any damage, claim, injury, cost or expense which is suffered or incurred by any person in connection with this competition, including any indirect, economic or consequential loss, any loss arising from the negligence of a relevant party and/or any liability for person’s injury or death.
  9. The laws of Western Australia govern this Promotion.

Returns Policy

All products you buy instore at Spudshed stores are covered by the Spudshed Stores Return policy

With Proof of Purchase
If you are not satisfied with the product you purchased from Spudshed, then we will happily refund the purchase price or exchange the product. The original receipt (or other proof of purchase stating date and time i.e. Bank statement or Credit Card statement) is required to be presented to enable our employees to issue a refund or exchange of product.

Spudshed reserves the right to have the product assessed for acceptable quality prior to providing you with a suitable remedy. Please return all items with packaging so we can make a proper assessment of damaged or spoiled products.

You will be required to provide photo identification, showing your name, address and signature and these details will be recorded for loss prevention.

To make a claim under our Returns Policy, you must return the item to any Spudshed Store. Any cost incurred by you in bringing the item back to the store will be borne by you.

Without Proof of Purchase
Products with a purchase price of less than $15 may be exchanged or store credit provided, to be used at the time of return at our discretion.

For products greater than $15 purchase price, we will, at our discretion, provide you with a store credit to be used at the time of return or refer your complaint to Head Office to resolve.

You will be required to provide photo identification, showing your name, address and signature and these details will be recorded for loss prevention

If you have changed your mind
In addition to claims related to quality, we will at our discretion refund the purchase price where you have simply changed your mind and you return a dry grocery product to us unopened, in its original packaging and with clear proof of purchase within 48 hours of purchase.

Unfortunately, we cannot refund or exchange for a change of mind on:

  • Fresh produce items (because we don’t know how they have been handled or stored once they have left our store)
  • Any refrigerated fresh food items such as dairy, meats, frozen goods (because of health and safety regulations)
  • Bedding (opened packaging) for health precautions
  • Clothes (opened packaging) for health precautions

The Australian Consumer Law
The Australian Consumer Law (brought into effect 1st January 2011) gives consumers a comprehensive set of rights for any goods or services purchased. These are called Consumer Guarantees, which means goods must be of acceptable quality and fit for the purpose they were designed for. Goods of acceptable quality will be:

  • Fit for all the purposes for which goods of that kind are commonly supplied;
  • Acceptable in appearance and finish;
  • Free from defects;
  • Safe and durable.

If goods or services fail to meet a guarantee, the consumer is entitled to a remedy in an attempt to right the fault (providing the goods were not used in an 'abnormal manner'). Should your goods fail to be of an acceptable quality due to a major failure you are entitled to a refund or replacement. A major failure is defined as:

  • The goods are significantly different from the description, sample or demonstration model shown to the customer;
  • The goods are substantially unfit for their normal purpose and cannot easily be made fit, within a reasonable time;
  • A reasonable customer would not have bought the goods had they known there was a fault/defect; or
  • The goods are unsafe.

If the failure is not major, you are also entitled to a repair or replacement within a reasonable timeframe or a refund if a repair or replacement is not feasible.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Manufacturer's warranty
Some General Merchandise come with a manufacturer's warranty (e.g. 1 or 2 years). If your product is covered by a manufacturer's warranty, you will find all the details you need within the information plate on the back of your product.

If during the period of the warranty, one of our high-quality products should fail to be of an acceptable quality, please do not hesitate to contact the manufacturer's helpline or your local Spudshed store for assistance. Please note that any manufacturer's warranty and Spudshed’s change of mind policy are additional to your rights under the Australian Consumer Law.
